Vol. 193 No. 2

Ceisteanna—Questions. Oral Answers. - Hire Purchase Costs.

22.

asked the Minister for Industry and Commerce if he is aware that the provisions of Section 27 of the Hire Purchase (Amendment) Act, 1960 under which enforcement of the right to recover possession of goods from a hirer may be obtained only by judgment of a judge or the master of the High Court is resulting in the imposition of heavy extra costs upon hirers; and if he is of the opinion that the section in question is not serving the purpose for which it was enacted.

I am not aware that the operation of Section 27 of the Hire-Purchase (Amendment) Act, 1960 is resulting in hardship to hirers as suggested by the Deputy. I have received no complaints or representations since the Act came into force which would indicate that the section in question is not serving its purpose, namely, to ensure that hirers in such court actions would not be deprived of various reliefs provided in the Hire-Purchase Act, 1946.
