asked the Minister for Local Government if the section of the Road Traffic Act, 1960, which gives a member of the Garda Síochána power to stop a car in order to test its brakes, is now in operation; if so, if the required percentage of braking efficiency, or stopping distance at various speeds, has been specified; and what the requirements are in this respect.

The section came into operation on 1st October last. It does not make provision for the laying down of standards of efficiency in braking. The powers of the Garda are related to cases where there is a defect affecting the vehicle which is such that it is when in use a danger to the public. This is a question which must be decided having regard to all the circumstances of the individual case.

I may add that the requirement with regard to braking in the Mechanically Propelled Vehicles (Construction, Equipment and Use) Order, 1934, is that the brakes of a vehicle be capable of bringing it to rest within a reasonable distance.
