Vol. 195 No. 2

Ceisteanna—Questions. Oral Answers. - Transfer of District Justices.

52.

asked the Minister for Justice whether his attention has been drawn to the remarks made on 27th April by District Justice Cahill on the subject of his transfer to the Children's Court in Dublin Castle; whether he has any comment to make on the remarks of the Justice as to the workings of the transfer system of Justices as at present operated; and whether, in view of the evident necessity for Justices with a particular interest in the problems of juvenile delinquency and children generally to be appointed to the Children's Court, he considers it desirable that any Justice be transferred to this Court against his expressed wishes.

I have seen newspaper reports of the remarks referred to by the Deputy. On the assumption that they are accurate, I can only regret that a District Justice should see fit to use the Bench for the purpose of discussing in public his personal position in relation to a matter of internal administration. The distribution of the business of the District Court in the Dublin Metropolitan District is arranged by the President of the District Court in accordance with Section 42 of the Courts (Supplemental Provisions) Act, 1961, and does not involve the transfer of a Justice from one District to another. It can be assumed that in arranging for the distribution of the business of the District Court in the Dublin Metropolitan District, the President of the District Court has regard to the suitability of the various Justices for the particular work to be assigned to them.
