asked the Minister for Industry and Commerce if he will amend the Holidays (Employees) Act, 1961 so as to provide for the payment of due holiday pay to the next of kin of a worker whose employment is terminated by death.

When the Holidays (Employees) Bill, 1961 was in course of preparation, I gave detailed consideration to the question of including in the Bill a provision of the kind suggested by the Deputy.

I was advised, however, that the inclusion of such a provision would raise complex questions which, in effect, could require the employer to exercise a function usually performed by the administrator of the estate of a deceased person.

I was satisfied that this would be too burdensome a task to impose by statute on an employer.
