Trade Marks Bill, 1962: From the Seanad.

The Dáil went into Committee to consider amendments from the Seanad.

I move that the Committee agree with the Seanad in amendment No. 1:

Section 64: in subsection (2), line 32, "or of a symbol" deleted.

The suggestion made in the Seanad which led to the acceptance by me in the Seanad of this amendment was also made in the Dáil. There are two amendments involved. The effect of the amendments is to make it an offence under the section to use, in relation to unregistered trade marks, such symbols as may be prescribed in the rules by the Minister. There is a practice that symbols are applied to trade marks which could indicate that they are registered trade marks. The purpose of the amendments is to ensure that certain symbols which must now be prescribed by the Minister may not be used, symbols which might indicate that unregistered trade marks are in fact registered. It is a point that was made both in the Seanad and in the Dáil and I think this amendment meets the case made in both Houses.

I move that the Committee agree with the Seanad in amendment No. 2:

Section 64: in subsection (2), line 33, "or of a prescribed symbol" inserted before "shall".

The same remarks apply to this amendment as to the previous amendment.

It is consequential.
