Copyright Bill, 1962: From the Seanad.

The Dáil went into Committee to consider amendments from the Seanad.

I move that the Committee agree with the Seanad in the following amendment:

Section 31: In subsection (4), page 37, lines 1 to 3, "relevant part of the copyright in a musical work and any person, or between the owner of that part" deleted and "right to broadcast a musical work incorporated in a cinematograph film" substituted.

Section 31 of this Bill as introduced originally in the Dáil provided for determination by the Controller of disputes between people who showed or had performed musical works which were incorporated in films and the owners of the copyright in the musical works themselves. The amendment made in the Dáil removed from the sphere of this section films which were used for ordinary cinematograph purposes and applied only to films used by Radio Éireann. This is consequential on an amendment made by the Dáil and it provides that the only dispute about payment for musical works incorporated in films that can arise is between the owner of the right to broadcast the musical work and Radio Éireann. This amendment has no great significance, once the principle had been accepted in the Dáil.
