asked the Minister for Local Government if, having regard to Section 21 of the Labourers Act, 1936, he is satisfied that local authorities can make loans available under the Small Dwelling Acts for the erection of houses on vested cottage plots; and if such plots can be made the subject of a second mortgage.

Where a cottage plot is subdivided to enable a second dwelling to be erected on part of the plot, the title to the subdivided portion may be registered free from the restrictions in Section 21 of the Labourers Act, 1936, if the deed of transfer submitted for registration so provides. Where this procedure is followed, a loan under the Small Dwellings (Acquisition) Acts may be advanced in respect of the second dwelling and the question of a second mortgage for the purpose need not arise.

When the Minister talks about submission for registration, does he mean at the time of vesting?

No. This would be subject to and consequent upon the local authority seeking, by consent of the Minister, to waive regulations so that they may make a sub-division.
