asked the Minister for Local Government if the members of a housing authority may by resolution declare that a specified list of applicants are qualified persons in need of housing; and if they may be resolution direct a county manager to proceed with a housing scheme for the qualified persons in the resolution.

41.

asked the Minister for Local Government if the members of a housing authority, rural or urban, may, by resolution and having regard to the recommendations of the medical officer, allocate the tenancies of houses when a scheme (a) is in preparation, or (b) is under construction; and if he will outline the function in this regard which may be exercised by resolution of the members of the housing authority.

With your permission, a Cheann Comhairle, I propose to take Questions Nos. 40 and 41 together. The formulation of building proposals and the letting of houses are executive functions of housing authorities. Section 4 of the City and County Management (Amendment) Act, 1955, provides that, subject to the provisions of that section, a local authority may by resolution require any particular act, matter or thing specifically mentioned in the resolution and which the local authority or the manager can lawfully do or effect to be done or effected in performance of the executive functions of the local anthority.
