Mr. Ryan

asked the Minister for Justice if he will introduce legislation to provide, where husband and wife die in circumstances which prevent the possibility of determining which of them died first, that the younger will be presumed to have survived the other partner.

A provision such as is suggested by the Deputy has proved unsatisfactory elsewhere and has led to highly undesirable results, particularly where the deceased were husband and wife. The problem of simultaneous deaths will, of course, be dealt with in the Bill relating to succession to property, which I hope to circulate shortly.
