asked the Minister for Local Government if he will arrange for the Dublin Corporation to be authorised to take in charge the laneways serving Shandon Crescent, Phibsboro, having regard to the resolution passed by the City Council in this regard on 4th September, 1961.

I understand that the resolution in question was a request from the City Council to the City Manager to take steps to take these laneways in charge, and that an examination by the Corporation of their powers to comply with the terms of the resolution has not yet been completed.

Would the Minister not make arrangements to give the Corporation the necessary powers to take these laneways in charge? The Corporation were not allowed to do it.

As I have indicated in reply to the Deputy's question, according to my information, the Corporation themselves have not yet come to any conclusion as to whether or not they have the power.

The Corporation have already said that they have no legal authority to do this but I am simply asking would the Minister authorise the Corporation to do so.

I must say back to the Deputy that my information at this moment is that an examination by the Corporation of their powers to comply with the terms of the resolution has not yet been completed.

May I ask the Minister to clear the situation with the Corporation and to get the work done?

As far as I can see, I have not any matter to clear with the Corporation on this subject at the moment.

They keep telling us they have no legal authority.

The only thing I can suggest to the Deputy is that it would be much quicker and more straightforward than my trying to do something about a matter where I am not sure what is required, if the Deputy, as a member of the council, were to raise the matter directly there and see what is the problem, because I am not aware of it.

For the Minister's information, may I say that there was a unanimous resolution passed that the lanes should be taken in charge. Subsequently, the legal advisers of Dublin Corporation said we had not got the power to do it.

My information is up to date, as far as I am aware, and it is that the Corporation have not completed their examination as to whether they can or cannot do what is being asked.
