Mr. James Tully

asked the Minister for Local Government if section 28 of the Public Health (Ireland) Act, 1878, section 1 of the Public Health (Ireland) Act, 1896 and section 19 of the Public Health Acts Amendment Act, 1907 are in operation in relation to (a) rural sanitary authorities and (b) urban sanitary authorities in 1966; if these enactments have been extended generally to rural sanitary authorities or to a limited number of rural sanitary authorities; and if any Orders have been made in relation to these enactments under section 33 of the Local Government Act, 1898 or section 1 of the Public Health (Ireland) Act, 1896.

asked the Minister for Local Government if he will give the text of section 1 of the Public Health (Ireland) Act, 1896, the definition of owner, section 28 of the Public Health (Ireland) Act, 1878, section 33 of the Local Government Act, 1898 and section 19 of the Public Health Acts Amendment Act, 1907, now out of print, indicating the extent to which these enactments apply to county councils.

Section 28 of the Public Health (Ireland) Act, 1878, is in force in relation to all urban sanitary authorities. The section does not specifically apply to rural sanitary authorities, but it may be applied to any rural sanitary authority by order under section 1 of the Public Health (Ireland) Act, 1896. No such order has been made. Likewise no general order has been made under section 33 of the Local Government (Ireland) Act, 1898, applying section 28 to all rural sanitary authorities.

Section 19 of the Public Health Acts Amendment Act, 1907, is in force in every sanitary district both urban and rural.
