asked the Minister for Industry and Commerce whether any protection at present exists in the form of a standards code for the sale of secondhand cars; whether he has held any discussions with the motor traders on this matter; and whether he is aware that false claims are made in the sale of many secondhand cars.

I have not received complaints or representations in regard to the standard of cars sold at secondhand, and I have had no discussions with motor traders on the matter.

It would be difficult, if not impracticable, to attempt to frame a standard code for secondhand cars relating to mechanical fitness except in so far as standards of safety are concerned. The question of minimum standards of safety is one for the Minister for Local Government.

Is the Minister aware that this problem has been tackled in other countries with some success, and it is not sufficient merely to say he is not aware of the problem, because it undoubtedly exists? Surely his Department should investigate this situation and see what, in fact, could be done, and not merely say it is impossible to legislate?

My Department have investigated the matter. The answer I have given is based on the result of that investigation.

Surely the Minister is aware of the position in relation to the rewinding of the clock? The car may have run 100,000 miles but the clock can be put back to show a mileage of 50,000, 55,000 or 40,000 and the mileage will be advertised as such. Surely the Minister should protect the public?

In so far as it can be established that that is being done, it can be dealt with under the existing law.

What law?

If a garage advertises a secondhand car for sale as having done a certain number of miles when, in fact, it has done considerably more, this is a matter that can be dealt with under civil law and possibly under criminal law at present.

Does it happen to State cars?

Does the Deputy suggest it did happen?

I am asking the question.

I do not believe it.

Surely the advertiser will state what the clock reads?

I think so.
