asked the Minister for Local Government if a poultry house proposed to be built three hundred feet from the public road comes under the heading of exempted development.

The Exempted Development Regulations, 1967, provide generally for exemption from planning control of poultry houses in rural areas but the exemption does not apply in certain specified circumstances, e.g., a poultry house which it was proposed to construct 300 feet from a public road would not be exempted if it would be sited within 100 feet of a dwellinghouse and the consent of the owner and occupier were not obtained. The exemptions scheduled in the regulations are also subject to general restrictions under Article 3 which might affect the particular type of case in mind, e.g., where the project involves opening a new access to a public road. The procedure for deciding any question as to what, in any particular circumstances, is exempted development is laid down in section 5 of the Local Government (Planning and Development) Act, 1963.
