Vol. 237 No. 15

Ceisteanna—Questions. Oral Answers. - Rights-of-Way.

90.

asked the Minister for Lands whether the Land Commission have power to acquire by agreement or compulsorily a right-of-way through lands for landowners in remote areas who have no right-of-way to the public road from their holdings; and, if not, whether it is proposed to give such powers to the Land Commission.

The powers of the Land Commission to confer, define, extend or improve rights-of-way or rights-of-access to lands sold or agreed to be sold under the Land Purchase Acts are as provided for by section 43 of the Land Act, 1923, section 39 of the Land Act, 1931 and section 33 of the Land Act, 1965. These powers are considered adequate for Land Commission purposes and further legislation is not contemplated at present.

If the Deputy has a particular case in mind and furnishes details, I shall arrange to have the matter investigated.
