Vol. 242 No. 4

Ceisteanna — Questions. Oral Answers. - Extradition Requests.

62.

asked the Minister for Justice if any requests have been made by the RUC for the extradition of any persons at present resident in the Republic; and, if so, if he will make a statement on the matter.

Extradition to the North is provided for in Part III of the Extradition Act, 1965. Sections 44 and 50 of that Act contain provisions the gist of which is that political, military and revenue offences are not extraditable. A person who is being extradited and claims that his offence falls into these categories may have the matter determined by the High Court. The same applies if a person is being extradited for an ordinary criminal offence and he claims that, if he is extradited for the offence specified in the warrant, he is likely to be prosecuted for a political offence, not specified in the warrant. In effect, therefore, the law applies only to people wanted for what might be described as ordinary crime and the release of information as to whether or not there is at present any warrant from the North awaiting execution here could serve only to give useful information to such people.
