asked the Minister for Lands if investigations have been completed regarding proposals for the acquisition of the estate of Rose Kelly (deceased) at Killarke and Mullylusty, Carrickmacross, County Monaghan; if it is now proposed to acquire same; and, if not, what are the reasons for reaching such decision.

The Land Commission have no dealings in respect of this property.

Further to the Minister's reply, the Land Commission have stated in reply to a letter that I wrote that they did not propose to take any action in acquiring this property despite the fact that I requested them to do so. This is within the last month.

There is nothing unusual about that. The Land Commission runs itself. The Deputies do not run it.

I am not suggesting that I should run the Land Commission.

Has the Deputy a question to put?

Is the Minister aware that this is a farm which has been let for years and years? Nobody owns this property and I had information only today that it is proposed to sell it. It has been let mainly to two people, one of them a young 20-acre farmer who has a right of way through part of the property. I should like to know why the Land Commission have been so vague.

I do not want to be vague in this regard. The Deputy has said that there does not seem to be any owner for this property. In fact, there are some rather old people involved in this. I know that the Land Commission are reluctant to take compulsory proceedings where very old people are involved.

There is nobody living on this holding. The people who own it are in an institution.

That is the point I have been making. The Land Commission are reluctant to take action against old people and to take over their land just like that.

Question No. 71.

I do not wish to be persistent in this matter but I have a few cases where the old people concerned wish to retain their holdings and the Land Commission are proceeding. There are peculiar circumstances attached to this case and I have grave doubts about the implications.

I am not aware of the peculiar circumstances. This is too vague an allegation. I have no reason to believe that there are any peculiar circumstances involved in it.
