asked the Minister for Local Government (a) when planning permission was granted for the erection of a meat factory at 229 New Cabra Road, Dublin; (b) if the erection of a meat factory at this site was in contravention of the terms of the lease for this site; (c) whether compensation to the owners of this building for the demolition of the building is being considered; (d) whether a fine is contemplated if the building was erected without planning permission; (e) whether the house at the site is a multiple dwelling or a single dwelling-house; and (f) if he will make a statement on the matter.

In so far as I am aware no planning permission has been granted for the erection of a meat factory on this site. The records in my Department show that on 28th December, 1966, the Minister, on appeal, refused an application for the retention of structures on the site which were being used as a bacon factory. The enforcement of the Local Government (Planning and Development) Act 1963, is a matter for the planning authority in the first instance and I would suggest that the Deputy should approach Dublin Corporation to see what steps they may be taking in this matter. The question of an action for breach of a covenant in the lease is also a matter for the corporation. I understand they have advised local objectors that they do not consider they would succeed in any such action. I have no information in regard to the other matters mentioned in the question.

asked the Minister for Local Government whether CIE must obtain planning permission from the local authority before they can build on their own land.

CIE are required to obtain permission under the Local Government (Planning and Development) Act, 1963, for the carrying out of development on their land unless the development proposed is exempted development. The Local Government (Planning and Development) Act, 1963 (Exempted Development) Regulations, 1937, exempt the carrying out by any railway undertaking of development required in connection with the movement of traffic by rail in, on, over or under the operational land of the undertaking except—

(i) the construction or erection of any railway station or bridge, or of any residential structure, office, or structure to be used for manufacturing or repairing work, which is not situate wholly within the interior of a railway station, and

(ii) the reconstruction or alteration of any of the aforementioned structures so as materially to affect the design or external appearance thereof.

Would the Minister state what steps he is prepared to take to see that CIE remove the cement silo which they have erected without planning permission on their land at Cabra?

The question refers to whether CIE require planning permission before proceeding with buildings on their own land. If the Deputy has a question about a silo it is a separate question.
