asked the Minister for Social Welfare if there is any provision whereby a bus conductor who is injured in lifting perambulators and packages on and off an omnibus is entitled to compensation for such injury or loss of time incurred; and, if not, why.

A bus conductor in employment which is insurable under the Social Welfare (Occupational Injuries) Act, 1966 is entitled to benefit under that Act if he suffers personal injury caused by an accident arising out of and in the course of such employment.

Entitlement to benefit under this Act does not prevent a person from pursuing an action for damages under the Civil Liability Acts or at common law.

Can we take it, then, that if a bus conductor loses part of a limb in the course of his employment he is entitled to claim against the Department of Transport and Power for compensation for such loss?

All other things applying, he would be entitled under the Occupational Injuries Act for injury and disability benefit as well as compensation for incapacity.
