asked the Minister for Transport and Power if he has approved any bye-laws made by the Dublin Port and Docks Board relating to the erection and maintenance of electric lights in the port in respect of which the board have a function; and, if so, what they are.

19.

asked the Minister for Transport and Power if he has approved any bye-laws made by the Dublin Port and Docks Board regarding the duties and conduct of sub-contractors employed by the board, particularly for dredging and land reclamation operations.

With your permission, a Cheann Comhairle, I propose to take Questions Nos. 18 and 19 together. No such bye-laws have been approved by me nor do the Harbours Acts provide for the making of bye-laws for such purposes.

asked the Minister for Transport and Power if he will make a harbour works order in respect of Dublin Port and Docks Board stipulating that any work already authorised by him shall where possible be done by the board's existing employees, and not by sub-contractors so as to avoid the likelihood of redundancy among the board's employees.

Under section 142 of the Harbours Act, 1946, the Dublin Port and Docks Board are entitled to enter into any contract which they think proper for the carrying out of any harbour works order or for dredging. There is no provision in harbours legislation requiring that harbour works be carried out by any particular category of employee. I am informed by the board that the question of redundancy does not arise.

asked the Minister for Transport and Power if he has given any directions to the Dublin Port and Docks Board regarding the disposal of material dredged from the port; and, if so, what they are.

Under the provisions of section 48 of the Harbours Act, 1946, the Dublin Port and Docks Board are required to take all proper measures for the cleaning, scouring, deepening, improving and dredging of their harbour and the approaches thereto, subject to any directions which I may give, as to the disposal of dredged material.

The board have been authorised by me to use dredged materials for reclamation work undertaken under the Harbour Works Order, 1967, and in accordance with the provisions of the Foreshore Act, 1933.

asked the Minister for Transport and Power if he has authorised the making of charges by the Dublin Port and Docks Board for the use of dredgers owned by them; and, if so, what they are.

I have received no proposals from the board for consent to charges for the use of their dredgers.
