asked the Minister for Industry and Commerce if he is satisfied that An Coimisiún Dumpála are effective in controlling dumping.

An Coimisiún Dumpála were set up in 1969 under the Imposition of Duties (Dumping and Subsidies Act), 1968, to investigate complaints of injurious dumping in accordance with the provisions of the Act and to make recommendations to the Minister for Industry and Commerce or the Minister for Agriculture, as appropriate.

I am aware that there has been criticism regarding An Coimisiún's handling of some dumping complaints. Dumping complaints involve a conflict of interests which it is not always possible to reconcile. In accordance with our international obligations, the provisions of the Act are in line with the principles and rules laid down by the GATT in relation to protection against dumping. An Coimisiún must have regard to these provisions in carrying out their investigations and making their recommendations. I am satisfied that An Coimisiún are performing their functions in accordance with these provisions and that action taken by them is effective in controlling injurious dumping.

I am sorry that the Minister for Industry and Commerce is not here. The Minister for Transport and Power said a fortnight ago that he did not think the commission were working very well and considered that a delay of nine or ten weeks in investigating complaints was too long.

I brought that to the notice of the Minister for Industry and Commerce.

And he does not agree?

He does agree and is investigating the matter with a view to expediting decisions with regard to applications.

I will try again in a fortnight's time.
