asked the Minister for Social Welfare why a social welfare claim made by a person in Limerick city (name supplied) was disallowed.

There is no record of a claim having been received in my Department from the person to whom the question refers. The Deputy is, however, aware from correspondence I have had with him that the person concerned sought a ruling on the question of the insurability under the Social Welfare Acts of his employment from 1967 onwards. A deciding officer decided that a contract of service did not exist in the case and that the employment was not, therefore, insurable. The person concerned appealed against the decision and the case was considered by an appeals officer. Following two oral hearings the appeals officer upheld the decision of the deciding officer and disallowed the appeal. In the absence of new evidence or new facts the decision of the appeals officer is final.
