asked the Minister for Social Welfare when pay related benefit will be paid to a person (details supplied) in Clonard, County Meath.

Pay-related benefit will be paid to the person concerned this week.

asked the Minister for Social Welfare when a decision will be reached regarding an application (details supplied) for unemployment benefit by a person in Ashbourne, County Meath.

The person concerned made a claim for unemployment benefit on 12th May, 1977, but continued at the same time to furnish medical evidence of incapacity in connection with a claim for disability benefit thereby indicating that he did not consider himself available for work which is a necessary condition for entitlement to unemployment benefit. He has since submitted medical evidence of his fitness for work with effect from 23rd November and on the basis of this a deciding officer has awarded him unemployment benefit with effect from that date. Arrangements have been made for payment of benefit this week.

asked the Minister for Social Welfare when a decision will be reached on the disability benefit claim (details supplied) by a person in Trim, County Meath.

The claim for disability benefit by the person referred to by the Deputy was disallowed from 8th August, 1977, following her examination by a medical referee who expressed the opinion that she was capable of work. The claimant appealed against the disallowance of benefit and in connection with her appeal she was again examined on 10th November, 1977, by a different medical referee who also found her to be capable of work. The appeal is proceeding and an oral hearing will be arranged as soon as possible.

asked the Minister for Social Welfare when a decision will be reached on the disability benefit appeal (details supplied) by a person in Trim, County Meath.

The claim for disability benefit by the person referred to by the Deputy was disallowed from 5th December, 1977, following his examination by a medical referee who expressed the opinion that he was capable of work. He appealed against this decision and in connection with his appeal, a further examination by a different medical referee has been arranged for 22nd December, 1977. His claim for benefit will be reviewed in the light of the medical referee's report on this further examination.

asked the Minister for Social Welfare why a person (name supplied) in County Offaly who applied for disability benefit in July last, has received no payment.

A claim to disability benefit was not made by the person concerned in July, 1977. Medical certificates showing incapacity for work from July, 1977, in respect of him were received in my Department on 7th November, 1977. The Social Welfare (Claims and Payments) Regulations, 1952, provide that where notice of incapacity is not given within seven days after commencement, the claimant shall be disqualified for receiving benefit in respect of any period more than seven days before the date on which the notice is given unless there was good cause for the delay in giving notice of incapacity, in which case benefit may be paid for a period not exceeding six months prior to the date of notification.

The claimant in this case did not at the time explain the reason for the late submission of the medical certificates. Payment of benefit was, accordingly, withheld and he was asked to say why they had not been forwarded in time. The explanation since received has been accepted and all disability benefit due to him has now been paid.

asked the Minister for Social Welfare why a person (name supplied) in County Offaly who applied for unemployment benefit in September last, has not received payment.

It was not possible to give a decision on the claim for unemployment benefit of the person concerned as her insurance record showed no insurance contributions in the year governing her claim. Following inquiries in the matter, contributions were subsequently paid and her claim for benefit has now been allowed. Arrangements have been made for payment this week to her.
