Vol. 306 No. 1

Written Answers. - Granting of Licences.

268.

asked the Minister for Justice if he will consider repealing the Dublin Stage Regulation Act, 1786 (details supplied), to give the District Court power to grant licences for theatrical performances in Dublin city and county.

269.

asked the Minister for Justice if he will introduce amending legislation to permit District Courts power to grant intoxicating liquor licences for the sale of liquor in theatres, with particular reference to section 7 of the Excise Act, 1835, and the Licensing Act, 1872

As I said in reply to a parliamentary question on 27 April 1978, I cannot undertake to give, by way of a reply to parliamentary questions, my views on the merits or demerits of any particular legal provision on which a Deputy might decide to seek comment nor can I undertake to indicate at Question Time what specific legislative proposals I might have. In this case the difficulties are even greater than usual since I am being called upon to give at short notice my opinion on a 200 year-old Act, the amendment or repeal of which might not even be a matter that would come within the area of my ministerial responsibility.

In reply to a parliamentary question on 26 April 1978 I said that many proposals to amend the intoxicating liquor laws have been made from time to time, some conflicting to a greater or lesser extent with others, and that, while I would consider all such proposals, I was not in a position to say whether it is likely that any amendments of the Acts would be proposed by me. The licensing of theatres to enable intoxicating liquor to be supplied in them would, naturally, be considered in the context of any general review of those Acts.
