Mergers, Take-Overs and Monopolies (Control) Bill, 1978: Report and Final Stages .

: I move amendment No. 1:

In page 5, between lines 39 and 40, to insert the following:

(b) For the purposes of this subsection, `turnover' does not include any payment in respect of value-added tax on sales or in respect of duty of excise.

This amendment is put down in response to some of what Deputy Kelly said on the last occasion and proposes to exclude value-added tax and excise duty in arriving at turnover figures for the purposes of section 2(1), the thresholds relating to the size of a company which would be subject to the provisions of the Bill. In the course of discussion on a more extensive amendment which was not accepted at that time, I indicated that I would be prepared to exclude these two duties for the purposes of computing turnover.

: We appreciate the Minister's meeting us at least this distance on this point and are glad to accept this amendment.

: Having considered the amendment, we also accept the position outlined by the Minister. It is without contention and I think it is useful and will make the whole approach more fair and equitable in the long run.
