Vol. 309 No. 4

Written Answers. - Law of Nullity.

413.

asked the Minister for Justice whether he proposes to make any changes in the law in relation to nullity; and if he will make a statement on the matter.

As the Deputy will recall, a discussion paper on possible changes of the law of nullity was issued under the auspices of the Attorney General during the term of office of the previous Government.

It is, I believe, fairly widely known that some of the proposals then put forward attracted criticism and, in view of that, a decision had been taken shortly before the change of Government to refer the entire matter of nullity for further examination by the Law Reform Commission, especially as there were other related matters that the commission were in any event to examine. It was in fact formally referred to them very shortly after the change of Government. This underlines the complexity of the issues and it will be appreciated that I could not consider asking the Government approval to any changes in the law until the commission have made their recommendations.
