Vol. 315 No. 16

Written Answers. - Noxious Weeds Act.

128.

asked the Minister for Justice if the Garda Siochána are responsible for the enforcement of the Noxious Weeds Act and the instructions, if any, not to prosecute local authorities for the presence of noxious weeds on their property.

The Garda Siochána do not institute prosecutions under the Noxious Weeds Act, 1936. Such prosecutions are taken by the Minister for Agriculture. The gardai make reports to the Department of Agriculture in appropriate cases where breaches of the Act are detected by them but, as they do not institute the prosecutions, the question of instructions to them not to prosecute local authorities does not arise.
