asked the Minister for the Environment if he will establish by way of Ministerial Order, under the relevant section of the Civil Liability Act, the liability of local authorities for negligence in cases of non-feasance, and if not, why.

I do not propose at this stage to recommend to the Government that an order be made bringing section 60 of the Civil Liability Act, 1961 into effect. I believe that road authorities are providing a reasonable service within the limits of the finances available to them. The amount of road grants for this purpose has been increased from £31.57 million in 1977 to £48.387 million in 1979. The matter can more appropriately be reviewed in the light of progress made in implementing the Road Development Plan for the eighties.
