Vol. 322 No. 1

Written Answers. - Family Law Summonses.

318.

asked the Minister for Justice the number of District Court maintenance and barring summonses issued in the Dublin Metropolitan District Court between 6 May 1976 and 6 May 1980 under the Family Law (Maintenance of Spouses and Children) Act, 1976.

The number of summonses issued on foot of personal applications for maintenance orders under the Act between 1 August 1976 and 6 May 1980 was 1,624.

The number of summonses issued on foot of personal applications for barring orders under the Act during the same period was 1,572.

Records relating to the period from 6 May 1976 to 31 July 1976 have unfortunately been mislaid. It has been estimated, however, that during this period the number of summonses issued on foot of personal applications for maintenance orders was 120 and the number of summonses issued on foot of personal applications for barring orders was 50.

In addition to summonses issued on foot of personal applications summonses are issued at the request of solicitors acting on behalf of clients. No exact figures are available in relation to the number of maintenance and barring summonses issued in this way but it is estimated that it would amount to about 2 per cent of the figures given above.

asked the Minister for Justice the number of District Court maintenance and barring summonses issued for the hearing of proceedings under the Family Law (Maintenance of Spouses and Children) Act, 1976 outside the Dublin Metropolitan District Court area between 6 May 1976 and 6 May 1980, inclusive.

The number of District Court maintenance and barring summonses issued for the hearing of proceedings under the Family Law (Maintenance of Spouses and Children) Act, 1976, outside the Dublin Metropolitan District during the period from 6 May 1976 to 31 May 1978 was as follows: Summonses issued on behalf of applicants for original maintenance orders, 1,501; Summonses issued on behalf of applicants for barring orders, 797.

In the time available it has not been possible to obtain the relevant particulars in respect of the period from 1 June 1978 to 6 May 1980. I will, however, arrange to have the information supplied to the Deputy as soon as possible.
