asked the Minister for Justice if he will introduce the necessary amendments in respect of barring orders, which would allow the judge involved to order the summons returnable to any court within his area, rather than the present insistence that all summonses issued are obliged to be issued for the District Court in which either reside, in view of the inevitable delays occurring in such circumstances.

Rule 5 of the District Court [Family Law (Maintenance of Spouses and Children) Act, 1976] Rules, 1976 (S.I. No. 96 of 1976) provides that proceedings under the rules may be brought, heard and determined before a sitting of the court for the court area, or in the case of the Dublin Metropolitan District, for the district, where either party to the proceedings ordinarily resides or carries on any profession, business or occupation.

It may be taken that, if the District Court Rules committee consider that there is a need for permitting cases outside the Dublin Metropolitan District to be dealt with at any sitting of the court in the relevant District Court District, the rules will be amended accordingly.
