asked the Minister for Finance the reason for the delay in the payment of expenses incurred by a garda (details supplied) in defending himself in judicial proceedings on matters arising during execution of his duty, at Cork District Court in December 1977; whether it is proposed to pay these expenses, and if so, when.

The Attorney General has been asked to give consideration to the question whether the circumstances of the case referred to, which was a criminal prosecution against the Garda, make it an appropriate case for the payment of costs from public funds. The matter is a complex one, involving, inter alia, consideration of a great deal of factual matter as well as a number of important questions of principle affecting other members of the force. I am informed by the Attorney General that it is hoped to complete consideration shortly.
