andMr. Clinton asked the Minister for Education if the Attorney General has exercised his powers under the Statutory Instruments Act, 1947, to ensure that the Model Lease or Deed of Trust for community schools is not treated as a statutory instrument to which the 1947 Act primarily applies; and if so, in which issue of Iris Oifigiúil it was published.

andMr. Clinton asked the Minister for Education if the present model lease or deed of trust for community schools has been issued in exercise of ministerial power or delegated authority; and, if so, under what statute.

With the permission of the Ceann Comhairle, I propose to take Questions Nos. 462 and 463 together.

By virtue of the Ministers' and Secretaries Act, 1924, I am given responsibility for the administration of Education in the State and am empowered to take the necessary measures in that regard.

The deed of trust for Community schools is not a statutory instrument but is a contractual agreement between the parties thereto.

By virtue of section 10 of the State Property Act, 1954, the Minister for Education is empowered to make a lease of State property.

The deed of trust is not a statutory instrument within the meaning of the Instruments Act, 1947.
