asked the Minister for the Environment if he will consider amending the law whereby one person on a private roadway can hold up a local improvement grant for that road by not signing the agreement form with the county council and his neighbours, in order to enable work to proceed in the absence of agreement; and if he will make a statement on the matter.

The local improvements scheme operates under the principle of voluntary consent given by all the parties involved in an individual scheme. I am satisfied, as were previous Ministers, that legislation to empower county councils to proceed with a scheme in the absence of consent by one or more of the parties whose lands or interests would be affected by it would not be justified.
