asked the Minister for Finance if he has received representations concerning the interpretation and application of section 21 of the Finance Act, 1980; and if, having regard to a case (details supplied) in County Dublin, the operation of the section results in between 28 per cent and 30 per cent of total gross earnings being paid in income tax; and the action he proposes to take in the matter.

I have received recent representations with regard to section 21 and its effect on the income tax position of the husband and wife in this case. In the circumstances of this couple, undercharges for the two years 1978-79 and 1979-80 have arisen because deductions from their respective incomes for these years under the PAYE system were insufficient to meet the statutory liabilities. These liabilities do, in fact, amount to 28.3 per cent for 1978-79 and 32.6 per cent for 1979-80 of the gross aggregated incomes in this case. Payment of the additional tax due has been refused and appropriate assessments are being made in accordance with the provisions of section 21 of the Finance Act, 1980, with a view to recovering the amounts due. These assessments may be appealed by the husband and wife, if they so wish, within 30 days of notification and will then be subject to the normal processing in such cases.
