asked the Minister for Social Welfare: (1) the number of administrative tribunals operating within his Department; (2) the number of such tribunals operating in bodies for which he is responsible; (3) the type of each tribunal; (4) the legislation under which each tribunal operates; and (5) the number of appeals to each tribunal and the number upheld in each of the past five years.

Although there appears to be no legally defined meaning of what an administrative tribunal is, it is being taken that the question refers to persons or bodies of persons established under legislation and having a specific appeals function.

On this basis there are nine administrative tribunals within my Department. These are appeals officers appointed under section 297 of the Social Welfare (Consolidation) Act, 1981, to adjudicate on appeals arising under that Act. There are no bodies for which I am responsible with administrative tribunals operating in them.

Regarding the number of appeals under the Social Welfare (Consolidation) Act, 1981, records are not kept in such manner as would enable all of the information sought by the Deputy to be given. The numbers of appeals decided by appeals officers in each of the past five years, however, were as follows:

Although the specific numbers of appeals allowed by appeals officers in those years have not been compiled, the percentage allowed would be about 30 per cent to 40 per cent of those decided.

There are no administrative tribunals operating within my Department.
