asked the Minister for Transport if he will give particulars of the terms of reference of the inquiry into the Buttevant train crash; the date its report will be published; if it will be made public; and the reason for the delay.

asked the Minister for Transport the reason for the delay in publishing the report of the Buttevant Rail Disaster which was promised last March.

With the permission of the Ceann Comhairle, I propose to take Questions Nos. 32 and 34 together.

In accordance with section 7 of the Regulation of Railways Act, 1871, the terms of reference of the formal investigation into the Buttevant rail accident, which occurred on 1 August 1980, provided for an investigation of the accident, and of the causes thereof and of the circumstances attending the same. The 1871 Act also requires that the persons carrying out an investigation shall make any observations on the accident or on the evidence or on any matters arising out of the investigation which they think right to make.

As Deputies are aware, the report of the investigation was published on 7 May 1981. There was no undue delay in the publication of the report.
