asked the Minister for the Environment if he is aware that the decision to shelve Dublin Corporation's Dublin Bay Amenity Order leaves Dublin Bay wide open to the possibility of a multi-national oil refinery being located there; and, if he will make a statement on the matter.

I am not so aware. Any proposals for development in the Dublin Corporation area will continue to be subject to the normal processes of planning control. In regard to the possibility of development outside the planning jurisdiction, the position is not affected by the decision referred to.

I understand that under the terms of an agreement made in January 1972 there is an undertaking by the Dublin Port and Docks Board that such developments in the port area would be carried out only in accordance with the terms of Harbour Works Orders made by the Minister for Transport and that planning permission would be applied for in accordance with the provisions of the local Government (Planning and Development) Acts. I also understand that it is a condition of all leases of port lands that the lessee must obtain planning permission.

The position in relation to local authority maritime boundaries generally is being examined in my Department.
