Vol. 330 No. 13

Written Answers. - Social Welfare Benefits.

577.

asked the Minister for Social Welfare when disability benefit will be paid to a person (details supplied) in County Leitrim.

The person concerned claimed disability benefit from 12 October 1981 to 4 November 1981, the date of the latest medical evidence received. As, according to the records of my Department, she has not the required minimum of 26 contributions paid or credited in the 1979-80 contributions year which governs her claim, she is not entitled to payment of benefit.

(Wexford) asked the Minister for Social Welfare when disability benefit will be paid to a person (details supplied) in County Wexford who applied in July 1981.

In reply to a similar question on 3 November 1981 I informed the Deputy that there is no record of the receipt of a claim for disability benefit from the person concerned. It has since been ascertained that the incapacity from which the person is suffering arose from an accident which was not connected with his employment. He is accordingly not entitled to injury benefit under the scheme of occupational injuries. As he had less than 26 weeks of insurable employment since his entry into insurance, he is not qualified for payment of disability benefit.

asked the Minister for Social Welfare when a living-alone allowance will be paid to a person (details supplied) in County Sligo.

A living alone allowance order book at the rate of £2.15 a week payable from 2 October 1981 issued to the person concerned on 30 October 1981 and the arrears due issued on 13 November 1981.

580.

asked the Minister for Social Welfare if she will pay occupational injuries benefit without delay to a person in County Dublin (details supplied).

The person concerned claimed injury benefit for the periods from 18 January 1980 to 30 January 1980, 16 February 1980 to 1 March 1980 and from 30 May 1980 to 25 July 1980 in respect of an accident at work on 25 November 1979.

Pending inquiries regarding the nature and origin of his incapacity he was paid disability benefit on an interim basis for the duration of these claims. On completion of the inquiries his claim to injury benefit was allowed in respect of the periods from 18 January 1980 to 30 January 1980 and from 16 February 1980 to 1 March 1980. All injury benefit due for those periods, less the amount of disability benefit paid on an interim basis, has been issued.

As injury benefit is limited to a maximum period of 26 weeks from the date of the occupational accident, the claimant was not entitled to payment of such benefit in respect of the period from 30 May 1980 to 25 July 1980. As already indicated he was however paid disability benefit in respect of this period. Arrangements are being made to have him examined by a medical referee at an early date with a view to determining his entitlement to disablement benefit.

asked the Minister for Social Welfare the reason for the six-month delay in paying unemployment assistance to a person (details supplied) in County Kerry, who is genuinely seeking work every day.

The person concerned is not entitled to unemployment assistance as his means derived from the value of board and lodgings exceed the maximum rate of unemployment assistance payable to him.

He has, however, been supplied with a form to enable him to appeal against the assessment of means in his case.

When the completed form is returned his case will be referred to an appeals officer for determination.
