asked the Minister for Industry and Energy if a company (details supplied) is conforming to Protocol 7 of Ireland's Treaty of Accession to the EEC; and if he will make a statement on the matter.

As the Deputy is aware, the decision by the firm in question to cease assembly work in September 1981 led to protracted negotiations with it as to the basis on which it might be afforded limited facilities for the continued import of fully built-up motor vehicles. Resolution on a mutually acceptable basis of the many complex factors involved, with which the Deputy will be generally familiar, had not been reached when proceedings in the High Court were initiated. The settlement of these proceedings, which at present must formally be regarded as adjourned, envisage that limited facilities for the importation of fully built-up cars will be afforded to the company in each of the years 1982, 1983 and 1984 subject to the company's complying with certain conditions which are designed to maintain employment and to create new employment opportunities.

Is it not a fact that Fiat (Ireland) Limited have not conformed to Protocol 7 and, facilities were therefore withdrawn from them? What is the basis now for granting them limited facilities for the importation of fully built-up units?

The basis for limited facilities at the moment is part of a proposed settlement reached in the High Court which stands adjourned. I am sure the Deputy is very familiar with the situation. That is conditional on certain obligations being enforced by Fiat (Ireland) Limited and until the case is finally decided in court I will not comment any further on the matter.

When can we expect the finalisation of the special arrangements the Minister is talking about?

It is due for mention in court on Monday if the final details have not been signed before then.

Could I give notice, because of the unsatisfactory replies I have received in relation to the Clondalkin Paper Mills, that I intend to raise the matter on the Adjournment?
