asked the Minister for Justice how many prosecutions were brought during 1981 for infringements of the regulations made under the Road Traffic Act, 1961, which require that vehicles must be so constructed, maintained and used as to prevent to such extent as is reasonably possible the emission of excessive smoke, visible vapour, fumes, noxious gases and offensive odours; if he will state how many convictions were recorded; and if he is in a position to state the penalties. if any, which were imposed by the courts.

I am informed by the Garda authorities that in 1981 there were 195 prosecutions and 160 convictions for infringements of article 30 of the Road Traffic (Construction, Equipment and Use of Vehicles) Regulations, 1963, as amended, which relates to the emission of smoke, visible vapour, etc., from vehicles. The figure for convictions does not include cases where the charge was proved and an order made without conviction.

The penalties imposed were of varying amounts between £5 and £20.
