asked the Minister for Justice whether the disciplinary action against a Garda (details supplied) which was deferred pending the completion of civil proceedings against him has been carried out.

Limerick East): Under the terms of the Garda Síochána (Discipline) Regulations, 1971, the question of disciplinary action against a member of the force is a matter for the Garda Commissioner.

I have been informed by the Garda authorities that, while the civil proceedings taken against the member concerned have been finalised, the member has instituted civil proceedings against another party involved in the case and that the practice has been that disciplinary investigations are not finalised pending the completion of relevant civil proceedings.

I an concerned that there should be such a delay in completing disciplinary investigations and I have asked that the matter be examined with a view to finalising the investigation at an early date.
