European Assembly Appointments: Motions.

I move:

"That Dáil Éireann hereby appoints Senator Flor O'Mahony of 38 Ulverton Road, Dalkey, County Dublin (who has been nominated in accordance with section 15 of the European Assembly Elections Act, 1977 by The Labour Party) to be a representative in the Assembly of the European Communities for the constituency of Dublin in place of Mr. John Horgan who was nominated in accordance with section 15 of the afore-mentioned Act by The Labour Party and who was appointed by Dáil Éireann and who has resigned as a representative in the Assembly with effect from 1st January, 1983."

This motion and the one which follows may be taken together.

I take it that it is in order to speak on these.

I would like to place on record my objection to the manner in which these EEC seats are being used virtually in a game of musical chairs by the Labour Party. The whole system which has developed in this State of replacing Irish members of the European Parliament is most unsatisfactory. It is bringing the whole matter of the acceptability of the EEC into question with people in this State. The two people being proposed in this instance did not at any time present themselves for election to the EEC. Both of them have on a number of occasions presented themselves for election to this parliament and failed. I would ask the Minister for the Environment to give an undertaking to this House that these two persons will remain as members of the European Parliament for the full term. Failing that, can we expect resignations in six months time in order to provide a handy spot for two more members of the Labour Party?

We do not propose to object to these two nominations and we are relieved to see that at least on this occasion the question of the dual mandate is not involved. The persons proposed are not Members of the Dáil, although one is a Member of the Seanad. While we are not opposing the appointments, it is necessary to draw attention to the fact that the Labour Party in this area do not behave with a great deal of responsibility and I feel that this constant changing of their members in the European Parliament is not reflecting credit on this country in that institution. I would hope that this is the last of these party political manoeuvres that we will see.

I do not complain at all about the quality of the two members now selected. They are experienced in our political life and in public affairs generally and I would not like to be taken as casting any aspersions whatever on their qualities or qualifications for membership of the European Parliament. However, from the point of view of the dignity of our political life here and our standing in the European Parliament it is time, as Deputy De Rossa rightly said, that this musical chairs type of operation should cease. Having said that, we will not object to these appointments.

In relation to what has been said by the Leader of the Opposition and Deputy De Rossa, membership of the national Legislature and the European Parliament is allowable under Community law. Any questions arising in relation to the dual mandate will best be dealt with by the Joint Committee on the Secondary Legislation of the European Communities, which include the matter of dual membership of the Dáil or Seanad and the European Assembly within their terms of reference. The Joint Committee have already touched on aspects of the dual mandate and the overall relationship between the Oireachtas and the European Assembly. A motion of expediency to both Houses of the Oireachtas to establish this Joint Committee is on the Order Paper of both Houses and will be moved shortly.

I am glad that the Leader of the Opposition has no personal objection to either member being nominated this morning and I am confident they will both do us justice in the European Assembly. As the European Parliament will run its term to 1984, I am also satisfied that both members will retain their membership to that date and will represent both the Labour Party and our country satisfactorily and with pride. I thank the Leader of the Opposition for the courtesy of allowing these motions to be put through this morning.

That Dáil Éireann hereby appoints Mr. Brendan Halligan of 14 Anne Devlin Drive, Rathfarnham, County Dublin (who has been nominated in accordance with section 15 of the European Assembly Elections Act, 1977 by The Labour Party) to be a representative in the Assembly of the European Communities for the constituency of Dublin in place of Mr. Frank Cluskey who was nominated in accordance with section 15 of the afore-mentioned Act by The Labour Party and who was appointed by Dáil Éireann and who has resigned as a representative in the Assembly with effect from 14th December, 1982.
