asked the Minister for Foreign Affairs the action he has taken to protect our duty-free situation at Dublin Airport and Ireland generally from current EEC moves.

I assume the Deputy is referring to a case currently before the European Court [Case 278/82] which originated with an action brought by a wholesale company and a retailer in the Baltic coast area of Germany. The German Court, to which the case was brought, referred to the European Court a number of questions regarding the legal basis for duty-free sales on board ferries. The court's judgment may have implications for the duty-free régime currently in operation on sea ferries and at airports, and in view of the major economic interest which Ireland has in the maintenance of the current régime, the Government has submitted written observations to the court defending the present system and has made arrangements to be represented at any oral hearings which may be held.
