asked the Minister for Social Welfare if a deserted wife's allowance will be restored to a person (details supplied) in County Wexford.

One of the conditions for the receipt of a deserted wife's payment is that a claimant and any other person must not be cohabiting as man and wife.

The deciding officer held that this condition was not satisfied by the person concerned since 3 February 1983 and her entitlement to deserted wife's benefit was terminated with effect from that date. She was notified of this decision on 29 February 1984 and of her right to appeal against it if she was dissatisfied with it. No appeal has been received to date.

asked the Minister for Social Welfare when disability benefit will be paid to a person (details supplied) in County Wexford.

The person concerned claimed disability benefit from 14 February 1984 and has been paid to 27 March 1984, the date of the latest medical certificate received, less the amount of supplementary welfare allowance advanced by the South Eastern Health Board.

asked the Minister for Social Welfare if an invalidity pension will be awarded to a person (details supplied) in County Wexford.

The person concerned is being paid disability benefit at regular weekly intervals and payment has been made to date.

A form on which to claim invalidity pension has been forwarded to him and on its return, duly completed, the claim will be dealt with without delay.

asked the Minister for Social Welfare when payments of unemployment benefit will be awarded to a person (details supplied) in County Wexford.

The entitlement to unemployment benefit from 6 February 1984 of the person concerned could not be determined until inquiries were completed to establish the reasons for his terminating his employment and if he fulfilled the condition of being available for employment.

These inquiries were recently completed and his claim to unemployment benefit was allowed at £34.80 weekly and pay-related benefit at £20.41 weekly, being the maximum rates appropriate in his case.

Arrangements have been made to pay all arrears due less the amount of supplementary welfare allowance due for recoupment to the health board. Further payments of unemployment benefit and pay-related benefit at the combined weekly rate of £55.21 will continue as they become due.

asked the Minister for Social Welfare the reason a person (details supplied) in Dublin 8 who was in receipt of unemployment benefit for the last 15 months has now been placed on unemployment assistance at the rate of £15 per week; and the basis on which this figure was reached.

The person concerned claimed unemployment assistance following the exhaustion of her title to unemployment benefit on 8 March 1984, when she completed 390 days. Her case was referred to a social welfare officer for investigation of her means after which she was assessed with £14.70 means weekly, derived from the value of her board and lodgings in her father's home.

She is, accordingly, in receipt of £15.65 weekly at present being the appropriate maximum rate in her case, £30.35 less £14.70 means.

asked the Minister for Social Welfare when unemployment assistance will be paid to a person (details supplied) in County Wexford.

The unemployment assistance claim of the person concerned was disallowed on the grounds that, by failing to furnish details of his self-employment, he failed to show that his means did not exceed the statutory limit.

He recently completed an appeal application form at his local office and arrangements are being made to refer his case to an appeals officer for determination. His entitlement to unemployment assistance will be reviewed in the light of the decision of the appeals officer.

asked the Minister for Social Welfare when arrears of invalidity pension will be paid to a person (details supplied) in County Wexford.

The person concerned has been awarded invalidity pension from 12 January 1984. A pension book payable from 1 March 1984 was issued to the designated post office on 27 February 1984.

A payable order covering arrears due for the period from 12 January 1984 to 29 February 1984, less the amount of disability benefit paid during that period, was issued on 28 March 1984.

asked the Minister for Social Welfare when unemployment assistance will be paid to a person (details supplied) in County Wexford.

Following a reinvestigation of his case the unemployment assistance claim of the person concerned was disallowed on the grounds that by failing to furnish details of his means he failed to show that his means did not exceed the statutory limit.

He appealed against the assessment of his means and in the light of contentions made by him in support of his appeal his case has been referred again to a social welfare officer for further inquiries. When these inquiries are completed the case will be referred to an appeals officer for determination. His entitlement to unemployment assistance will be reviewed in the light of the appeals officer's decision. He is in receipt of supplementary welfare allowance pending the outcome of his unemployment assistance claim.

asked the Minister for Social Welfare the reason for the delay in the payment of maternity benefit arrears to a person (details supplied) in County Monaghan.

The person concerned was paid maternity benefit under the general scheme for the 12-week period 20 June 1983 to 10 September 1983 and the claim was paid on a regular weekly basis. There are no arrears due on the claim. A statement of entitlements and a list of payments made are being sent to her.

asked the Minister for Social Welfare the reason payment of unemployment benefit was refused to a person (details supplied) in County Donegal.

It has not been possible to trace receipt of a claim to unemployment benefit or unemployment assistance which refers to the person named in the details supplied. Further inquiries in the matter will be made if the Deputy will furnish additional information to enable the person concerned to be identified.

asked the Minister for Social Welfare when the appropriate rate of unemployment assistance will be paid to a person (details supplied) in County Galway.

The person concerned was assessed with means at £17.35 weekly derived from the value of board and lodging while resident in her parents home and from contributions made by her parents towards her upkeep when she removed to another address. She was, accordingly, paid unemployment assistance at £11.55 weekly, being the maximum rate of unemployment assistance payable to her, £28.90 less £17.35.

She appealed against the amount of means assessed against her and in the light of contentions made by her in support of her appeal her case was referred to a social welfare officer for further investigation. Following the completion of inquiries her means were re-assessed as nil with effect from 20 October 1983. She is, accordingly, entitled to the maximum rate of unemployment assistance payable to her £28.90 weekly and arrangements have been made to pay all arrears due this week. Further payments of £28.90 will be made as they become due.

asked the Minister for Social Welfare when disability benefit will be paid to a person (details supplied) in County Louth.

The person concerned claimed disability benefit from 14 January 1983 and was paid to the 16 January 1984 based on her contribution record for 1981-82, the contribution year governing her claim.

From 17 January 1984 her entitlement to benefit was determined by her contribution record in the 1982-83 contribution year and as she has less than the required minimum of 26 contributions registered in that year she was not entitled to further payment. According to the records of the Department she has 16 credited contributions registered in that year. Credited contributions, which preserve the continuity of her insurance record, have been awarded in respect of medical certificates submitted to 29 March 1984, date of the latest medical evidence received.

asked the Minister for Social Welfare when unemployment benefit will be paid to a person (details supplied) in County Louth.

Availability for work is a condition of entitlement to unemployment benfit and to fulfil this condition an applicant must be capable of, available for and genuinely seeking work. The unemployment benefit claim of the person concerned was disallowed on the grounds that she was making no efforts to find work and accordingly she did not fulfil the condition of being available for work. It is open to her to appeal against the disallowance of her claim. A form for this purpose may be obtained at her local office.

asked the Minister for Social Welfare if free telephone rental will be made available to persons (details supplied) in County Cork.

In order to qualify for a free telephone rental allowance an applicant must be living entirely alone or only with children under 15 years of age or other persons who are so permanently incapacitated as to be unable to summon aid in an emergency. The person concerned has been asked to furnish additional medical evidence in respect of his wife who resides with him in support of his application. When this evidence is received his application will be considered and he will be notified of the outcome.
