asked the Minister for the Environment if a nurse's retirement pension will be paid to a person (details supplied) in County Westmeath.

The determination of the entitlement of an employee of a health board to a pension is a matter for decision in the first instance by the health board concerned, in accordance with the relevant legislation. It is understood from the Midland Health Board that the person concerned was not employed in a pensionable capacity when she ceased to be employed by them in 1981 and that accordingly, she was not entitled to a pension under the superannuation code.

However, a scheme was introduced in 1977 to provide for the payment of gratuties on retirement to certain persons who because of the conditions of their employment are not eligible to be pensionable. Under this scheme the person concerned was paid a gratuity in respect of her service.
