A person holding a position in the public sector who is convicted by the Special Criminal Court of a scheduled offence under the Offences Against the State Act, 1939 (a) forfeits such position (under Section 34 (1) of the Act) and (b) is disqualified for holding any position in the public sector for a period of seven years from the date of conviction (under Section 34 (3) of the Act).
The Government may under section 34 (5) of the Act, at their absolute discretion, remit, in whole or in part, any forfeiture and disqualification are not remitted, it is still open to the person concerned, on the expiration of the seven-year disqualification period, to apply for a position in the public sector in the normal way (e.g. by competing at a Civil Service Commission competition).
