asked the Minister for Communications the action he proposes to take to avoid defaulting by tour operators in view of the acknowledged over provision in seat numbers by the operators.

Subject to compliance with legislation governing the operation of inclusive tour charter flights, the making of arrangements for the provision of transport capacity for overseas holiday charters is a matter for commercial decision by individual tour operators.

Since 1 November 1983 no person may carry on business or hold themselves out as a tour operator or travel agent without the required licence and associated bond under the Transport (Tour Operators and Travel Agents) Act, 1982. In the event of the inability or failure of a licensed tour operator or travel agent to meet his obligations to the public in relation to overseas travel, I am empowered under the Act to utilise the bond of the defaulting operator or agent to repatriate, compensate or assist any member of the travelling public who incurs a loss or liability. Where the liabilities falling to be met exceed the value of the bond, I have at my disposal the resources of the travellers' protection fund established under the Act.
