asked the Minister for Justice when he intends to have published or made available submissions made in the context of developing the Whitaker report, which were not submitted on the basis of absolute confidentiality; and if he will make a statement on the matter.

I refer the Deputy to the answer to Question No. 233 of 12 November last (vol. 361 No. 8 col. 1865) in which it was indicated that, apart from the fact that it was not clear that certain submissions apparently regarded by the Committee of Inquiry into the Penal System as being "non-confidential" would, in fact, be so regarded by their authors, other issues arose which would have to be considered. Consideration of these issues is continuing and I am arranging to have a number of individuals and organisations who made submissions to the committee approached in order to ascertain their views on the committee's suggestion that these submissions be deposited in various libraries.
