asked the Minister for Health the terms of employment of a person (details supplied) in County Wexford who was employed as a maintenance supervisor by the South Eastern Health Board, the reason he has not been able to work according to these terms, and if he will be able to do so in the future.

As the Deputy is aware the officer concerned has already made an application under section 14 (6) of the Health Act, 1970, in respect of his conditions of employment. When such application are made particular care is taken to ensure that both parties (in this case the officer concerned and the chief executive officer of the South-Eastern Health Board) are given every opportunity to state their sides of the case.

In the light of all the lengthy submissions made, including counter submissions recently made, the matter is now being finally assessed and I hope to be in a position, in the very near future, to make a decision in this case.
