asked the Minister for Social Welfare if he will arrange to have payment of disability benefit continued to a person (details supplied) in County Kilkenny who appeared before a medical referee from this Department on 9 April 1987 and has received no payment since.

The person concerned claimed and was paid disability benefit from 28 August 1985. On 9 April, 1987 the claimant was examined by a medical referee of the Department who expressed the opinion that she was incapable of work, and recommended a further review of her case in January 1988.

There was no break in payment arising from the medical examination. Payments were issued in the normal course in response to medical certificates submitted and all benefit payable on this claim has been issued to 20 April 1987, the date of the latest medical certificate submitted to the Department.

asked the Minister for Social Welfare when a person (details supplied) in County Louth will receive unemployment assistance for himself and his family.

Following investigation of the unemployment assistance claim of the person concerned he has been assessed with means of £86.55 weekly, derived from the profit from part-time self-employment as a motor-cycle mechanic. His rate of unemployment assistance will be £1.05 per week, being the difference between the appropriate maximum weekly rate payable in his case of £87.60 less weekly means of £86.55.

He is currently in receipt of unemployment benefit at the weekly rate of £83.35 and accordingly will not be entitled to unemployment assistance until such time as entitlement to that benefit expires, which will be when he has been paid benefit for a further 35 days.

asked the Minister for Social Welfare the reason disability benefit cannot be paid to a person (details supplied) in County Kerry in view of the fact that he has been submitting certificates each week for the past 14 months, and if he will make a statement on the matter.

The person concerned claimed disability benefit from 4 November 1985. He is not qualified for payment as nil contributions are recorded for the 1983-84 contribution year which governs his claim to disability benefit. From 5 January 1987 his entitlement to disability benefit is based on his insurance record for the 1985-86 contribution year. He was not initially qualified for payment from that date as only 22 contributions were recorded for that contribution year.

However it was subsequently established that he had 49 contributions registered for the 1985-86 year and is therefore qualified for payment. Accordingly, all arrears of benefit payable to him from 5 January 1987 to 24 April 1987 (the date of the latest medical certificate received), less the amount of unemployment assistance paid in respect of the person concerned on his wife's claim, have been issued.
