asked the Minister for the Marine the measures he intends taking to protect the rights of people to boat on lakes and rivers in the light of recent court decisions which appear to indicate that those who own fishing rights have the power to prohibit these activities; and if he will make a statement on the matter.

I presume the court decisions referred to in the questions were those given in the High Court in November last when permanent injunctions were granted to the owners of Lough Inagh Fishery, Connemara and to a company, who had proved that they had an equitable interest in the property, preventing canoeing, surfboarding, boating and any other activity likely to cause interference with or depreciation of their fishing rights and estate.

The decisions in question relate to a particular fishery and were taken in the light of the nature of the rights relating specifically to that fishery.

In these circumstances I do not intend to introduce any measures as a result of the court decisions in question.
